COMPLIANCE REQUIREMENTS FOR COMPANIES IN VIETNAM

We wish to alert you to Decree 69/2024/ND-CP, which came into effect on 1 July 2024. Decree 69 imposes mandatory electronic identification and authentication requirements for all citizens, foreign nationals, and organisations operating in Vietnam.

Importantly, 30 June 2025 is a key compliance deadline under Decree 69.

Key point to note:

All Vietnam-domiciled enterprises are required to complete certain electronic identification procedures and obtain an electronic identification account (“eID Account”) from the Public Security Department by 30 June 2025.

Any enterprises who have not yet taken the necessary steps to achieve compliance with Decree 69 should do so without delay. We have embedded within the Client Alert a step-by-step guide to achieving such compliance.

Investment project periodic reporting compliance

In addition, all enterprises who hold an Investment Registration Certificate ought to be aware of the risks to which they are exposed if they are not fully up-to-date with their periodic investment project reporting obligations. The attached Client Alert highlights this issue and notes that key State authorities have recently begun to take stronger enforcement action against non-compliant enterprises.

IRC-holding enterprises who may not be in full compliance with their investment project reporting obligations are encouraged to take action to address this, without delay.
